All Third-Party Suppliers must sign and agree to the terms and conditions of the Indemnity and Hold Harmless Agreement attached to these Standard Terms and Conditions.
All Third-Party Suppliers wishing to have items billed to them directly must submit a completed credit application and letter of agreement (available upon request) to the Nines accounting department no less than 10 working days prior to its arrival.
All ballroom sets must be drawn to scale on a floor plan/diagram and have approval by the local fire marshal in advance. A copy must be sent to the Nines event manager prior to the event. Failure to do this may cause delay in the meeting and reset of all equipment. Additional charges may apply due to any delay.
Emergency exits must remain clear at all times.
Illuminated exit signs cannot be covered or obstructed.
Scaffolding must have scaffold jack feet attached. Bare piping is not permitted on carpeted or tiled surfaces. Piping or scaffolding pieces must have at least half an inch (0.5”) thick wood supports between it and any carpeted surfaces.
All Third-Party Suppliers must place on file with the Nines proper evidence of insurance with insurance companies having a minimum rating of A+ and admitted to do business in the state where the Nines is located. The Nines requires a minimum of $2,000,000 per occurrence General Commercial Liability and Business Automobile Coverage. Insurance certificates must endorse the Nines and Five-Star AudioVisual as additional insured and must contain provisions for 30 days prior to any change or non-renewal of the policies. The certificate must also reference the Third-Party Suppliers obligations with respect to the Indemnity and Hold Harmless Agreement. Such insurance shall be primary and contributory with the Nines or Five-Star Audiovisual insurance. In addition, the Third-Party Supplier(s) must also provide the Nines and Five-Star AudioVisual with evidence of proper worker’s compensation insurance.
A security deposit in the amount of $500 is due seven (7) days prior to the event to protect the Nines from any damages or clean-up during the movement and/or operation of equipment. This deposit or a portion of the deposit may be refunded at the Nines’ discretion upon review and inspection of the premises. A pre- and post-walk can be arranged with a Nines event manager. Third-Party suppliers will also be held responsible and held liable for any damage caused by its agents, contractors, free- lancers, employees and staff.
All third-Party Suppliers are required to comply with all applicable laws, rules, regulations and codes established by federal, state and local authorities including OSHA and Fire and Safety. In the event services include pyrotechnics and/or use of smoke/fog machines, it is the Third-Party Supplier’s responsibility to obtain necessary approval and/or permits from the local fire marshal.
All Third-Party Suppliers must comply with all rules established by the Nines including, without limitation, access to/from The Nines premises, badges/name tags, dress codes and cleanliness on or about the Nines’ premises. Access will be denied to any Third-Party supplier and/or its employees or subcontractors that fail to comply with such rules and/or these Standard Terms and Conditions.
No smoking is permitted in meeting rooms, other public areas, mezzanines or catwalks. Failure to comply with the rules and policies of the Nines will result in a $500 charge to the group’s Master Account for each violation.
Third-Party Suppliers are fully responsible for leaving the Nines premises in the same condition as existed prior to the event, including, without limitation, disposing and removing from the Nines premises all trash, props, cardboard and plastics at the Third-Party Supplier’s sole cost. All floor surfaces must be protected with proper floor covering during load-in and load-out. Any marks, stains or abrasions to the floor, walls or any other surfaces shall be reported to the Nines staff. Third-Party Suppliers are responsible for cleaning up refuse such as balloons, glitter, boxes, etc. the Nines will arrange to have any damaged areas cleaned or repaired using proper techniques at the Third-Party Supplier’s sole expense. The use of nails, screws or the like in all floors, walls and ceilings is strictly prohibited, unless written permission is first received from The Nines staff. The Third-Party Supplier is fully responsible for obtaining and reviewing all the Nines rules prior to the event.
In the event the Nines does not have adequate facilities available for the storage or safekeeping of the Third-Party Supplier’s audiovisual equipment, material, tools, supplies and other items necessary for the event, the Third-Party Supplier will be solely responsible for securing all of its property while on the Nines premises. The Nines and Five-Star AudioVisual will not be liable for any damage or theft relating to Third- Party Supplier’s property on the Nines premises regardless of cause. Equipment stored in the room must be kept no less than two (2) feet to zero (0) inches away from any wall. Empty production cases may not be stored in back hallways.
Equipment/consumables required for cable management are solely the responsibility of Third-Party Suppliers and vendors. Cords or cabling are not permitted in front of doorway thresholds. All cords must be securely and safely taped. Cable ramps are necessary for audio snakes, three phase cables, lighting harnesses and other large cables. The Nines has the right to change any wiring that it considers unsafe or cable routes that have not received authorized approval.
Third-Party Supplier shall not access the Nines and meeting rooms through public elevators and public passageways utilized by guests of the Nines. The Third-Party Supplier must use freight and service elevators, service corridors and service hallways for all operations on the Nines premises including load-in/load-out, where elevators and service corridors are provided.
Third Party Suppliers must verify, on a daily basis, any wireless frequencies being used at the Nines to Five-Star AudioVisual to ensure that communications and utilized frequencies are not jeopardized or disrupted by Third-Party Supplier’s operations on the Nines premises. Five-Star AudioVisual will provide a frequency list of equipment in use and on-site. Any conflicts will result in the Third-Party Supplier to adjust or turn off offending equipment.
Third-Party Supplier’s will have limited access to the Nines loading zone. Subject to availability, Third-Party Supplier may have access to loading zone provided a request is submitted to the Nines at least 48 hours in advance. Loading docks may only be used during load-in and load-put periods. Employees or subcontractors of Third-Party Supplier must use employee-parking area at all other times as subject to availability.
In the event a Third-Party Supplier will be using the services of a subcontractor in connection with the event, the Third-Party Supplier is responsible for informing such subcontractor of these Standard Terms and Conditions, and the Third-Party Supplier will be fully responsible for the subcontractors conduct while on the Nines premises.
Five-Star AudioVisual will make itself available during the event to provide any additional audiovisual equipment, operational and technical labor and other related services requested by the guest and/or the Third- Party Supplier. Upon any such request, Five-Star AudioVisual will charge the client/guest for all services rendered at Five-Star AudioVisual’s prevailing rates which will then be billed to the event Master Account.
All events that require rigging must inform the Nines audiovisual department as Five-Star AudioVisual is the exclusive rigging contractor of the Nines. All rigging must be scheduled at least seven (7) days in advance. Rigging charges will be billed to the event Master Account.
Five-Star AudioVisual exclusively operates the Nines’ in-house sound system or any other permanently installed audiovisual equipment located in meeting rooms and ballrooms. If a guest/client of Third-Party Supplier requires use of the in-house systems in connection with the event, Five-Star AudioVisual must be engaged to operate the in-house systems at Five-Star AudioVisual prevailing rates.
The Third-Party Supplier is required to provide Five-Star AudioVisual a complete schedule of events at least seven (7) days before load-in including the date and time of load-in and load-out, times of amplified audio reproduction, power tie- in/disconnect schedule and “dark room” schedules.
Third-Party Suppliers will also incur charges for power usage and rental of the Nines’ power lifts. All such charges will be at the Nines’ prevailing rates. The undersigned has reviewed and acknowledged these Audiovisual Standard Terms and Conditions and agrees to be bound by each of the provisions contained herein. By signing below, the guest/client agrees to be responsible for any charges incurred in connection with these Standard Terms and Conditions that may be billed to the guest/client’s Master Account. The individual signing on behalf of a company personally represents that they have the authority to sign this agreement on behalf of their company and bind their company to the provisions contained herein.
